Montezemolo's lost the plot. Fancy threatening the FIA with possible legal action. Ferrari look to be on a collision course with the FIA after the team's president reportedly warned of possible legal action should the budget cap go ahead, resulting in an "unfair" and "biased" Championship.
Despite choosing not to publicly comment on the FIA's £40m budget cap, it has emerged that Ferrari President Luca di Montezemolo has written a strongly worded letter to Max Mosley, in which he accuses motorsport's governing body of "undermining the image of F1" and causing "serious damage" to the sport. His argument simply isn't credible, for the most part. Presumably he thinks allowing Ferrari and McLaren to spend twice as much as everyone else produces a "fair" and unbiased" championship.

McLaren and BMW aren't too thrilled by it either, but it's an increase of 10m from what was originally proposed.
However, as the cap remains voluntary, it seems Montezemolo is just intent on making enemies. Why he's talking about legal action for a voluntary measure is beyond me.

Why he's talking about legal action for a voluntary measure is beyond me. The workings of the budget cap seem a bit bizarre to me. It seems certain restrictions (e.g. on testing) won't apply to teams that come in under the cap, but then surely all those extra things cost money anyway. In all honesty, I don't think 'soft' budget caps are really very effective. Everyone should run to the same maximum budget, and with the same restrictions.
